    FAQs Patent Questions

    Patent
    Question: What is a patent?

    Answer:

A patent is a property right granted by the Government of the United States of America to an inventor “to exclude others from making, using, offering for sale, or selling the invention throughout the United States or importing the invention into the United States” for a limited time in exchange for public disclosure of the invention when the patent is granted.

Question: The patent law specifies that its subject matter must be useful, meaning it is able to perform its intended purpose.

    Answer:
The patent law specifies that the subject matter must be “useful.” The term “useful” in this connection refers to the condition that the subject matter has a useful purpose and also includes operativeness, that is, a machine which will not operate to perform the intended purpose would not be called useful, and therefore would not be granted a patent.

Question: Are published patents the only content of the Electronic Official Gazette - Patents?

    Answer:
No. The eOG:P contains a section called Patent and Trademark Office Notices.
